JoyLabs Terms of Service
Chapter 1 Welcome!
Article 1 Purpose and Definition
JoyLabs (hereinafter referred to as the company) thanks you for using the services provided by JoyLabs. We have prepared the “JoyLabs Terms of Service” (hereinafter referred to as this agreement) to make it easier and more convenient for you to approach the various internet and mobile services (meaning Hiary, etc.) that the company provides.
Users (hereinafter referred to as members) can use the services by agreeing to this agreement. However, in the case of paid services provided by the company, a paid service agreement between the company and the member is concluded at the time of agreement on the paid service terms. This agreement regulates basic rights, obligations, responsibilities, conditions and procedures necessary for members to use the services. Please read this agreement carefully.
The definitions of terms used in this agreement are as follows:
- “Member” means a customer who accesses the company’s services and enters into an agreement with the company in accordance with this agreement and uses the services provided by the company.
- “ID” means a combination of characters and numbers that the member determines and the company approves for identification and service use.
- “Termination” means the termination of the service agreement between the company and the member after the service is opened.
- “Post” means information in the form of characters, pictures, videos, and various files and links posted on the service.
- “Service” means the basic functions such as writing, editing, and deleting posts on the Hiary platform of the company.
- “Sub-service” means functions such as learning support and learning record analysis provided in the service.
Article 2 Effect and Changes of Terms
- The contents of this agreement are published on the service screen or other methods of notice or notification, and the effect is exerted on all members who agree to this agreement.
- The company may change this agreement within the scope that does not violate the relevant laws if necessary. When this agreement is changed, the company will notify or notify the members 15 days before the implementation date through the service notice, and if the change is disadvantageous to the members, it will notify them through email (or other separate electronic means such as displaying an alert message in the service) 30 days before the implementation date.
- The company will notify or notify the members 7 days after the notice or notification date from the date of the notice or notification, and if the members do not express their dissent within 7 days after the notice or notification date, the changed agreement is deemed to be approved.
- Members can terminate the service agreement by expressing their dissent to the changed agreement.
- This agreement is applied from the date the member agrees to this agreement until the termination of the service agreement according to Article 12 of this agreement. However, some provisions of this agreement may remain effective even after the termination of the service agreement.
Article 3 Supplementary Rules
- For matters not specified in this agreement, the relevant laws, the operation policies and rules of the service, the terms of use of the sub-service in the service, the operation policies and rules of JoyLabs (hereinafter collectively referred to as the detailed guidelines) shall apply. In addition, if the contents of this agreement and the detailed guidelines conflict, the detailed guidelines shall apply.
Chapter 2 Service Agreement
Article 4 Conclusion of Agreement
- To join the service, you need a JoyLabs account. If you do not have a JoyLabs account, please create a JoyLabs account first.
- The service agreement is concluded by the company after the member agrees to the contents of this agreement and the company confirms the member’s JoyLabs account information, etc.
Article 5 Limitation on Service Registration
- According to Article 4, the company accepts the applicant who agreed to this agreement. However, the company may refuse to approve the service agreement in the following cases until the reason for the refusal is resolved. In particular, if the applicant is under 14 years old, the service agreement can only be entered if the parent or legal guardian has given their consent.
- The applicant has used the personal information of another person, such as the name or email address, to join the service.
- The capacity of the service provision equipment is not sufficient.
- There is a problem in the technical part of the service provision.
- In addition, if the company considers it necessary for financial or technical reasons,
- In the case where the person who has received a service suspension or other measures from the company arbitrarily terminates the service agreement and applies for re-registration during the suspension period,
- In cases where the applicant violates the above conditions and is found to have joined the service, the company may immediately suspend the service use of the user or delete the JoyLabs account, etc.
 
Chapter 3 Service Use
Article 6 Service Provision
- After the service agreement is concluded, the member can freely use the sub-service constituting the service at any time, and there is no need to conclude a separate service agreement for the sub-service.
- However, in some cases of the sub-service within the service, it is necessary to agree to the separate service agreement, and it is necessary to complete the certification procedure specified by the company, such as adding additional information, email address approval, SMS authentication, certificate issuance, etc.
- The member can terminate the use of the sub-service at any time through the function provided in the sub-service screen or menu after joining the service, and except for the information that must be stored for a certain period according to the relevant laws, all data such as the service use history and the posts written by the member are immediately deleted. However, if the post written by the member is posted by a third party through the scrap or other sharing function, or if the member adds a post to the post of a third party, etc., the post and the post are not deleted, so please delete it before terminating the use. In case of termination of the service or sub-service use, there may be a separate instruction that the use of the service may be restricted for a certain period in the future, so please pay attention to the instruction and use the service within the time limit.
- The termination of the use of the service or sub-service according to the preceding paragraph means only the termination of the use of the service or sub-service, and the use of other services using the JoyLabs account is not terminated. If you want to terminate the use of the JoyLabs account, you must terminate the service agreement according to Article 12 of this agreement.
- The company provides various services that can be used through the internet and mobile, such as the bulletin board service, online content provision service, etc.
- The company provides a license for the software necessary for the member to freely use the service, which is personal, worldwide, non-transferable, and non-exclusive. However, please note that the company does not grant the right to use the company’s trademarks and logos to the member.
- The company may provide an updated version of the software necessary for the service at any time. The update may include the addition or removal of important or unnecessary functions. Please update the service regularly to use it conveniently.
- The company protects users from spam posts (including phishing, virus distribution, personal information theft, etc.) by responding to spam and security measures for posts. In addition, if the relevant agency recommends or the company determines that it is necessary for user protection, it provides additional spam operation policies and functions.
- The company may display various information related to the use of the service, such as notices, management messages, and other advertisements, on the service or send them directly to the contact information registered in the JoyLabs account information of the member. However, in the case of sending advertising information, it is only sent if the recipient has agreed to receive it in advance.
- If you find any problems during the service use, such as system errors, please contact the customer center at any time.
- If you use the service without using Wi-Fi wireless internet and connect to the wireless internet of the mobile carrier you joined, please note that the mobile carrier may charge you an additional data communication fee. The data communication fee incurred during the service use must be paid to the mobile carrier under your own cost and responsibility. For detailed information on the data communication fee, please contact the mobile carrier you joined.
Article 7 Changes and Termination of Service
- The company will do its best to provide the service 24 hours a day, 365 days a year without interruption. However, in the following cases, the company may limit or terminate the entire or part of the service.
- In the case of regular or temporary maintenance for the equipment for the service
- In the case of a power outage, equipment failure, or excessive use of the service
- In the case of termination of the contract with the related company, government orders/regulations, changes in the service/member policies, etc., due to the company’s circumstances
- In the case of other natural disasters, national emergencies, etc.
 
- In the case of service suspension due to the preceding paragraph, the company will notify or notify the member in advance in the method specified in Article 16 (Notice and Notice). At this time, there may be a need for re-login or additional consent procedures for the service use in order to provide a smooth service and policy changes. However, if the company cannot predict or control the reason (disk or server failure, system failure, etc.) for which the company is not at fault, it will not be possible to notify or notify in advance. In such cases, the company will try to restore the service as soon as possible and, if it takes more than 2 hours to restore, will post it on the service notice, JoyLabs customer center notice, etc.
Article 8 Management of Posts
- If the member’s post contains content that violates the relevant laws, such as the Information and Communication Network Act (hereinafter referred to as the “Information and Communication Network Act”) and the Copyright Act, etc., the rights holder may request the company to suspend or delete the post in accordance with the procedure specified by the relevant law, and the company will take appropriate action in accordance with the relevant law.
- Even if the rights holder does not request, the company may take temporary measures (such as suspension of posting) against the post if there is a reason that can be recognized as infringement of rights or if the post violates other policies and relevant laws.
- The detailed procedures related to the above are subject to the rights infringement reporting procedure specified by the company within the scope of the Information and Communication Network Act and the Copyright Act.
Article 9 Assignment of Rights and Use of Copyrighted Works
- 
The member can post posts, such as photos, articles, information, (video) content, opinions, suggestions, etc., about the service or JoyLabs on the service. The intellectual property rights, including the copyright, of such posts belong to the rights holder and are retained by the rights holder. 
- 
The member grants the company a worldwide license to use the posts posted on the service in various ways, such as use, storage, modification, public transmission, display, distribution, etc. The rights granted by the member to the company in this license are used within the scope of the purpose of operating, improving, promoting, and developing the service, and the sub-license to the other party who has concluded an explicit business contract with the company or other users within the scope of the purpose is also included here. In addition, the company may use the posts for the purpose of improving and developing the service. Some individual services may provide a way for the member to access or delete the content they have provided (however, the deletion of the post may not be possible depending on the characteristics of some services and the nature of the content). In addition, some services may have a setting that limits the use of the content provided by the company. 
- 
The member must retain the rights necessary for the company to grant a license to the content provided by the company. The member is responsible for all problems that occur due to the lack of such rights. In addition, the member cannot post or publish content that is obscene, violent, or otherwise violates public order and laws. 
- 
The company may delete or refuse to post content that violates relevant laws, such as obscene or harmful content to minors, content that incites discrimination, spam, content that transfers or trades accounts, content that impersonates others, etc. However, the company is not obligated to review all content. If someone infringes on the member’s rights, the member can request help from the customer center regarding the request to suspend posting. The specific criteria and procedures for the use restriction related to the above are available in the JoyLabs operation policy. 
- 
Some content that is not owned by the company may be displayed on the service. In such cases, the entity that provided the content is solely responsible for all matters related to the content. The member does not have any rights to the content of other users even if they use the service. To use the content of other users, the member must obtain separate permission from the content owner. 
- 
The company may use the member’s posts or other content in a way other than the second paragraph by obtaining the member’s consent in advance through telephone, fax, email, etc. 
Article 10 Use of Paid Services
- Most of the sub-services constituting the service are provided free of charge, but some sub-services may be provided for a fee.
- When the member uses the paid service provided by the company, it is the principle to use the service after paying the service fee. The payment methods for the paid service provided by the company include mobile payment, credit card payment, prepaid electronic payment methods, etc., and there may be differences in the payment methods for each paid service. In the case of a service where monthly payments are made, unless the member personally requests the cancellation of the monthly payment, the monthly payment is made.
- The company may require additional personal information of the member in order to fulfill the payment obligation. The member must provide the personal information requested by the company accurately.
- The payment terms for the paid service of each sub-service are specified in the payment terms for the paid service of each sub-service, and if there is a conflict between the contents of this article and the contents of the payment terms for the paid service of each sub-service, the payment terms for the paid service of each sub-service shall apply.
Article 11 Service Use Method and Precautions
- The member can freely use the service, but the following actions are prohibited:
- The member must not provide false information when applying for or changing the service, or use the JoyLabs account and password of another person, use it improperly, or use the name of another person without the permission of the name holder, etc.
- The member must not copy or distribute the information obtained by using the company’s service information without the company’s prior approval, or use it commercially.
- The member must not damage the reputation of another person or cause disadvantage to another person.
- The member must not post obscene materials or connect to obscene sites (link) in bulletin boards, etc.
- The member must not infringe on the rights of the company or other third parties, such as copyright, etc. (including actions that infringe on the rights of third parties, such as the company’s IP access block, etc., even though the company has taken technical measures to prevent infringement of rights against others, and the user has accessed the service through means and methods such as tricking the company, etc.)
- The member must not post false information about the company or other third parties in the service.
- The member must not spread information, sentences, shapes, sounds, etc. that violate public order and good morals.
- The member must not register or spread computer viruses that cause equipment malfunctions or information destruction and confusion.
- The member must not spread information, sentences, shapes, sounds, etc. that violate public order and good morals.
- The member must not copy, modify, distribute, sell, transfer, lend, or provide security to another person, or allow another person to use the software, or reverse-engineer the software, or extract the source code, etc.
- The member must not impersonate another person or falsely state the relationship with another person.
- The member must not collect, store, or disclose the personal information of another person.
- The member must not spread false information to cause damage to oneself or another person, such as to gain an advantage in property or cause damage to another person.
- The member must not gamble or engage in gambling activities.
- The member must not spread information, sentences, shapes, sounds, etc. that encourage sexual misconduct.
- The member must not spread information, sentences, shapes, sounds, etc. that cause fear or disgust.
- The member must not spread information that violates the relevant laws, such as computer programs.
- The member must not impersonate the company’s employee or operator, or use the name of another person, etc., to post articles or send E-mails, messages, etc.
- The member must not post or send software, hardware, electronic communication equipment, etc. that may cause equipment malfunctions or system failures.
- The member must not engage in stalking, false or malicious reporting, etc., that harass other users.
- The member must not repeatedly engage in the act of terminating the service or purchasing a paid service within one month, etc., that unfairly abuses the service.
- The member must not violate the detailed instructions for the service provided by the company, such as the relevant laws, this agreement, and the operation policy.
 
- The member must not transfer or transfer the rights and positions of the service or other service agreements to another person, and must not provide them as collateral.
- The member’s qualifications or age may limit the use of the service as follows:
- The member under 19 years of age (except for those born on January 1 of the year in which they turn 19, the same applies to the following) cannot use the youth-harmful media under the provisions of the Information and Communication Network Act and the Youth Protection Act.
- In order to use the youth-harmful media, you must be 19 years of age or older, and you must be certified as your own and age by实名认证. If you do not certify, the use of the corresponding service will be limited.
- The service of the member under 19 years of age may be limited for a certain period of time if the request of the legal guardian or the consent of the member under 19 years of age is obtained.
 
- If the member does not comply with the relevant laws, all terms and policies of the company, the company may investigate the member’s violations, and in case of need, take the following measures:
- Delete or temporarily delete the relevant posts.
- Temporarily or permanently suspend the use of the member’s account or part of the service, or part of the detailed sub-service constituting the service.
- Restrict the re-use of the service or part of the detailed sub-service.
- If the member’s service or equipment malfunctions or system failures, etc., and the service provides an adverse effect or seriously妨碍 the stable operation, the member’s account will be restricted.
 
- The company may limit the service use step by step in the following cases:
- If the member violates the obligations of this agreement or hinders the normal operation of the service: warning, temporary suspension, contract termination, etc.
- If the member violates the Copyright Act, the Computer Program Protection Act, the Information and Communication Network Act, etc., and provides illegal programs, hacks, distributes malicious code, exceeds access rights, etc.: immediately terminate the contract and forfeit the service benefits (no separate compensation)
- If the member does not log in for more than 3 months: deactivate the account for the protection of member information and operational efficiency
 
- The Company shall determine the terms and details of the restriction of use pursuant to Paragraph 5 in a separate restriction of use policy, and shall notify the Member in accordance with Article 16 (Notification and Notice) when restricting use.
- The member may lodge an objection through the customer center in case of dissatisfaction with the action result related to the restriction of use.
- The restriction of use is generally limited step by step from temporary restriction to permanent restriction according to the accumulated degree of violation of the activity, but in cases where immediate permanent restriction is required, such as the posting of obscene content, the spread of obscene content, the promotion of gambling, etc., which are prohibited by relevant laws, the accumulated degree of violation of the activity and the degree of related to the activity are not considered.
- For detailed information on the matters stipulated in this article and other matters related to the use of the service, please refer to the JoyLabs operation policy, etc.
Article 12 Termination of Service Agreement
- If the member withdraws from the JoyLabs account, the service use agreement is automatically terminated.
- If the member wishes to terminate the service use agreement, the member may apply for termination at any time through the menu provided in the service, and the company will promptly process it in accordance with the relevant laws.
- When the service use agreement is terminated, all data such as the member’s information or posts made by the member will be deleted, except in the case of retaining certain information of the member in accordance with the relevant laws and regulations and the Joylabs Privacy Policy. However, if the posts created by the Member are posted by a third party as a clip or other sharing function, or if the Member adds posts such as comments to the posts of a third party, such posts and comments will not be deleted, so please delete them before applying for termination.
- Posts not deleted by the Member pursuant to the preceding paragraph will remain in the Service to the extent necessary for the normal use of the Service by other users.
- The termination of the paid service use contract is established by the member’s application for termination of the paid service use contract and the company’s approval, and if there is an amount to be refunded, a refund will be made. However, if you have purchased a detailed sub-service for which regular monthly payments are made, you cannot be refunded for the remaining days. If the method and effect of contract termination is different from these Terms, it shall be as stipulated in the terms of each paid service and related detailed guidelines.
- For some subservices that make up the Service, if you do not use such subservices for a certain period of time, we may destroy or segregate your information, or restrict your access to some or all of the features of such subservices. For more information, please refer to the detailed guidelines of each subservice.
- Even if the Service Use Agreement has been terminated, the Member may apply to the Company to enter into a Service Use Agreement again. However, if a member applies to conclude a service contract again after terminating the service contract while the use of the service has been suspended due to the member’s failure to comply with the relevant laws, these Terms and Conditions, and detailed guidelines, there may be a certain time limit on the service subscription. In addition, in the case of some sub-services that comprise the service, the immediate use of the sub-service after concluding a service contract again may be subject to certain time limits as stipulated in Article 6.3.
Article 13 Personal Information Protection Obligations
- The company regards the safe handling of the member’s personal information as one of the most important matters. The member’s personal information is used only within the scope of the purpose and scope agreed by the member for the smooth provision of the service. Since the company will never provide the member’s personal information to a third party unless the member agrees separately, you can rest assured. For more information on the efforts and other details the company makes to safely handle the member’s personal information, please refer to the JoyLabs Privacy Policy, etc.
- However, the JoyLabs Privacy Policy is not applied to linked sites other than the official site of the company.
Chapter 4 Miscellaneous
Article 14 Compensation for Damages
- The company does not make any specific commitments or guarantees for any specific matters not specified in this agreement in relation to the integrated service within the scope permitted by the relevant laws. In addition, the company does not guarantee the reliability and accuracy of information, materials, facts, etc. posted on the service by the CP (Contents Provider) or the member, etc., and does not bear any responsibility for damages incurred by the member due to the company’s negligence.
- If the company causes the member to suffer damages due to the company’s negligence, the company shall compensate the member’s damages in accordance with this agreement and the relevant laws. However, the company shall not be liable for damages such as the following, which occur due to the company’s negligence:
- Damages caused by natural disasters or other calamities
- Damages caused by the member’s negligence in using the service
- Damages caused by personal injury during access or use of the service
- Damages caused by a third party illegally accessing or using the company’s server
- Damages caused by a third party interfering with the transmission to or from the company’s server
- Damages caused by a third party spreading or disseminating malicious programs
- Damages caused by omissions, omissions, destruction, etc. of transmitted data, defamation, etc., incurred by a third party while using the service
- Damages caused by other reasons other than the company’s intentional or negligent acts
 
- The company shall not be liable for any services provided free of charge in relation to the use of the service, unless there is a special provision in the relevant law.
- The company shall not be liable for any losses incurred by the member due to the loss of expected profits from the use of the service, or any losses incurred by the member due to the use of the service through other services.
- The company shall not be liable for any disputes arising between members or between members and third parties through the service, unless the company is negligent.
- The contents not specified in this agreement shall be specified in the terms of each detailed sub-service within the service, and if there is a conflict between the contents of this article and the contents of the terms of each detailed sub-service, the terms of each detailed sub-service shall apply.
Article 15 Protection of Minors
The service is a space where all age groups can freely use it as a basic space, and in order to protect minors from harmful information and help them safely use the internet, the Information and Communication Network Act has separately implemented the youth protection policy, and the specific contents can be checked in the initial screen and the terms of each detailed sub-service constituting the service, etc.
Article 16 Notice and Notice
The company values the exchange of opinions with the members. The member can submit opinions at any time by visiting the JoyLabs customer center. The notice to all service users is effective by posting it for at least seven days in the service notice section. In the case of matters that have a significant impact on the member, the company will notify or notify the member through email (if the email address is not registered, the service will send an electronic message, display an alarm message in the service, etc.) or send a KakaoTalk message or text message to the member’s registered phone number, etc.
Article 17 Jurisdiction and Jurisdiction
- These Terms and Conditions or the Service shall be governed and implemented by the laws of the Republic of Korea. If a dispute arises between the Company and the Member regarding the use of the Service, we promise to negotiate in good faith to resolve it. If it is still not resolved, you may file a lawsuit with a court of competent jurisdiction under the Civil Procedure Act.
- The lawsuit filed between the Company and the Member shall be governed by the laws of the Republic of Korea.
- Lawsuits concerning disputes between the Company and the Member shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the Member’s address at the time of filing, or if there is no address, the district court having jurisdiction over the Member’s residence. However, if the Member’s address or residence is not clear at the time of filing, the competent court shall be determined in accordance with the Civil Procedure Act.
- In the case of a Member whose address or residence is located overseas, the Seoul Central District Court of the Republic of Korea shall be the competent court for any dispute between the Company and the Member, notwithstanding the preceding paragraph.
This Agreement shall take effect on August 1, 2025.
